Inheritance Rejection

Renunciation of an Inheritance is a legal action whereby a person entitled to inherit expressly refuses to accept the inherited estate along with all the rights and obligations attached to it. This renunciation is typically done to avoid the deceased’s debts or for other personal reasons.

This service aims to ensure that the renunciation process is conducted legally and is legally binding, as well as to protect clients from potential liability for the decedent’s obligations. We provide assistance ranging from consultation and document preparation to filing petitions with the court in accordance with applicable regulations in Indonesia, specifically based on the Civil Code (KUHPerdata) regarding inheritance law.

Legal Basis :

  • The Civil Code (KUHPerdata), specifically the provisions regarding inheritance (including Articles 1045–1058)
  • Relevant provisions in civil court practice (District Court)

Types of Inheritance Renunciation :

  • Express (Formal) Renunciation of Inheritance — Carried out through an official statement at the District Court, thereby having the force of law.
  • Tacit (Implicit) Renunciation of Inheritance — Occurs when the heir does not take any action to accept the inheritance; however, this approach is risky in practice and is not as legally binding as formal renunciation.
